Section 307-X-1-.19 - Disposition of Forms
After completing and signing the certificate of result, the election officials shall seal the ballots, certificates, and other records as follows:
(1) Where precinct ballot counters are used:
(a) The list of registered voters, the record of assisted voters, the ballot accounting certificate(s) and the first copy of the certificates of result shall be placed in an envelope addressed to the judge of probate who shall keep them for public inspection and/or election contest, and the list of registered voters or a copy thereof may be used by the board of registrars in updating their records.
Here is an easy copy and paste option to send to your probate judges just to make things easier on all of you… these ballot accounting certificates are VERY important!
Judge _______,
I am requesting an opportunity to inspect the Ballot Accounting Certificates and results tapes returned to you from the voting places after the November 8, 2022, General Election.
Attached, are the Administrative Rules governing the disposition of the records I have requested. The Ballot Accounting certificates are required to be completed “immediately after the last vote is cast” and are signed by the election officials before posting results at their voting places. They are, and should be, in your custody since you received returns after the closing of polls on election day.
The records are to be maintained for public inspection. While I understand the complexities of completing post-election duties, these are simply part of the returns you received and should not be difficult for you to provide for inspection. I would appreciate an immediate response and a time to inspect the requested public records.
Sincerely,
Code Section 307-X-1-.19 - Disposition of Forms is what you can site to prove THESE ARE OPEN TO THE PUBLIC FOR REVIEW.
